Terms of Service — 1024 (Merge Puzzle)

1. Acceptance of these Terms
These Terms of Service ("Terms") form a binding agreement between you and Kfir Kahanov ("we",
"us", "our"), an individual developer established in Israel, and govern your download,
installation, and use of the mobile game 1024 (Merge Puzzle) (Android package
com.kksoftware.merge1024) ("1024", "the app"). By downloading, installing, or using
the app, you confirm that you accept these Terms. If you don't accept them, please don't use the
app, and uninstall it.
These Terms are between you and us only. Google is not a party to them, but your download of the app and any in-app purchase you make are also subject to Google Play's Terms of Service and, where you use them, the Google terms referenced in sections 5 and 7. Our Privacy Policy explains what data the app collects and how it's handled; it forms part of your agreement with us, and this document doesn't repeat it.
The app is a general-audience game and is not directed at children under 13. If you are under the age of majority where you live, you may use the app only with the involvement and consent of a parent or legal guardian, who accepts these Terms on your behalf and is responsible for any purchases made from their device or Google account.
2. What the app is — and what it isn't
1024 is a free-to-download, single-player sliding-tile number-merging puzzle game. It has no account system, sign-up, login, or user profile of our own, and no backend server of ours. Your progress — best score, coin balance, unlocked cosmetic tile themes, settings, and your in-progress board — is stored locally on your device using Android's Jetpack DataStore, as described in section 1 of our Privacy Policy.
The app can be played offline. An internet connection is used only to show ads (section 6), to process in-app purchases through Google Play (section 5), and — if you choose to use it — for the optional Google Play Games Services features (section 7). We don't guarantee that any of those online features will be continuously available.
1024 is an independently developed implementation of a well-known number-merging puzzle concept. It is not affiliated with, endorsed by, or sponsored by the developer of any other game in that genre, and it is not endorsed by or affiliated with Google beyond our ordinary use of Google Play and Google's developer SDKs.
3. Licence to use the app
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use the app on Android devices you own or control, for your own personal, non-commercial entertainment. We do not sell you the app or any copy of it — all rights not expressly granted here are reserved by us or our licensors.
You may not, and may not permit anyone else to:
- Copy, distribute, sell, rent, lease, lend, sublicense, or otherwise make the app available to third parties, except through Google Play as distributed by us.
- Modify the app, create derivative works from it, or distribute modified, repackaged, or "cracked" builds of it.
- Reverse-engineer, decompile, disassemble, or attempt to derive the source code or assets of the app, except and only to the extent that applicable law expressly permits this despite this restriction (for example, mandatory interoperability rights) — and in that case, only after you've asked us in writing whether we can supply the information you need.
- Extract, republish, or reuse the app's artwork, icons, sounds, text, or theme palettes outside the app.
- Remove, obscure, or alter any copyright, trademark, or other proprietary notice in the app.
For clarity, you are welcome to record, stream, and publish videos or screenshots of your own gameplay, including on monetized platforms, as long as you don't distribute the app itself, its installer, or its assets as a standalone download.
This licence ends automatically if you materially breach this section or section 4.
4. Acceptable use
You agree not to:
- Use the app for any unlawful purpose, or in any way that breaks applicable law or the rights of others.
- Tamper with, bypass, or exploit the app's virtual-currency, purchase-verification, or advertising systems — including editing or injecting save data, patching the app, using memory editors or modified clients, or otherwise granting yourself coins, themes, or the ad-removal entitlement without earning or paying for them.
- Generate invalid ad activity — for example, clicking or triggering ads automatically, by script, by bot, or by encouraging others to do so — which also breaches Google's AdMob policies.
- Submit falsified scores or achievement progress to the Google Play Games leaderboard, or otherwise misrepresent your results (section 7).
- Deliberately interfere with, disrupt, or place unreasonable load on the app or on any Google service it relies on.
- Abuse the refund process, for example by repeatedly requesting refunds for content you continue to use.
If we reasonably believe you've done any of the above, we may stop supporting your installation, invalidate coins, themes, or entitlements obtained through tampering, terminate the licence in section 3, and report the activity to Google. Because the app keeps your data on your own device and we operate no accounts, our practical remedies are limited to these — and we won't take any of them arbitrarily.
5. In-app purchases and virtual currency
The app is free to download and offers optional in-app purchases: a one-time Remove Ads purchase, and consumable coin packs (small, medium, and large tiers). Purchases are entirely optional — the app is fully playable without them.
Payment and pricing. All purchases are processed by Google Play's billing system, under your billing relationship with Google. The price you pay is the price Google Play displays to you at the moment of purchase, in your local currency and including any taxes Google indicates. We never see, receive, or store your payment details (see section 4 of our Privacy Policy). We may change prices, coin-pack contents, or in-app item costs in future versions of the app; any such change applies only going forward and never to a purchase you've already completed.
Coins. "Coins" are a virtual in-app currency. You do not own coins; you receive a limited, personal, non-transferable, revocable licence to use them inside the app — currently to pay for undoing a move and to unlock cosmetic tile-colour themes. Specifically:
- Coins can also be earned for free, through the daily login bonus and optional rewarded ads. No purchase is ever required to obtain coins.
- Coins have no real-world monetary value and are not your property, a bank deposit, a stored-value instrument, or any kind of currency or security.
- Coins cannot be sold, traded, gifted, transferred between devices, accounts, or players, or exchanged or redeemed for cash, goods, or anything of value outside the app.
- Unused coins have no value, are not refundable or redeemable, and cease to function if you stop using the app or if the app is discontinued (section 11).
Where your purchases live. Coins and unlocked themes are stored locally on your device, so they may be lost if you uninstall the app, clear its storage, or lose the device. The Remove Ads entitlement is a non-consumable purchase recorded in your Google Play account, so it's restored when you reinstall the app and sign in to Google Play with the same account. The optional Play Games cloud save (section 7) is intended for your in-progress board and should not be relied on as a backup of your coin balance.
Refunds. Because Google Play processes every payment, refunds are handled by Google under Google Play's refund policy — please direct refund requests there. Apart from that, and apart from any rights you have under mandatory law, purchases are final once the content has been delivered to your device. If a purchase fails to deliver what you paid for (for example, coins aren't credited or ads aren't removed), contact us at [email protected] and we'll do our best to put it right, including supporting your refund request with Google.
Statutory withdrawal rights. Digital content bought in the app is delivered to you immediately on purchase. Where the law of your country gives consumers a cooling-off or withdrawal period for digital content, by completing a purchase you ask for immediate delivery and acknowledge that you may lose that withdrawal right once delivery has begun. This does not affect your non-waivable statutory rights if the content is faulty or not as described.
You are responsible for purchases made from your device or Google account. If minors have access to your device, we recommend enabling Google Play's parental controls and purchase authentication.
6. Advertising
The free version of the app is supported by advertising served through Google's Mobile Ads SDK (AdMob): banner ads, interstitial ads, and optional rewarded video ads. AdMob is the only ad network the app integrates.
Rewarded ads are always voluntary. You choose whether to watch one in exchange for coins or an undo; nothing in the app requires you to watch a rewarded ad to keep playing.
Remove Ads. Purchasing Remove Ads (section 5) removes banner and interstitial ads from the app. Rewarded ads remain available to you afterwards, deliberately — so that you can still choose to earn coins that way if you want to. Removing ads doesn't otherwise change gameplay.
Ad content is not ours. Ads are selected and delivered by Google and its advertising partners. We don't create, review, endorse, or control the content of individual ads, the products or offers they promote, or the websites they link to, and any dealings you have with an advertiser are between you and that advertiser. If you see an ad you believe is inappropriate or deceptive, please tell us at [email protected] so we can report it to Google. Ad availability depends on Google's ad inventory and your connection, so a rewarded ad may sometimes be unavailable; we don't guarantee that any particular number of ads, or any particular amount of coins from ads, will be available to you.
What data ad serving involves, the consent flow, and your opt-out controls (including Settings → Privacy & Ad Choices in the app) are described in section 3 of our Privacy Policy.
7. Google Play Games Services (optional)
The app optionally integrates Google Play Games Services (v2) to offer a leaderboard, achievements, and cloud saving of your in-progress game. This is entirely optional: the app is fully playable and feature-complete without ever signing in, and we operate no account system of our own — sign-in uses your own Google account, managed by Google.
If you choose to use these features, your use of Google Play Games Services is additionally governed by Google's Terms of Service and Google's Privacy Policy, and by your Play Games profile settings — which, not us, control how your gamer name and scores appear to other players. Availability, behaviour, and continuity of Play Games Services are controlled by Google and may change or end at any time, outside our control.
Cloud save is a convenience feature, not a guaranteed backup service. Where the same game is saved from more than one device, the most recently saved board replaces the older one. We recommend you don't treat cloud save as your only copy of anything you'd be upset to lose.
We may remove or reset leaderboard entries or achievement grants that appear to be falsified or obtained by tampering (section 4). Google may independently take action under its own policies, including in relation to your Google account, which is a matter between you and Google.
8. Intellectual property
The app and everything in it — its source code, game logic, user-interface design, artwork, icons, tile-theme colour palettes, sounds, and text — is owned by us or licensed to us, and is protected by copyright and other intellectual property laws. The name "1024 (Merge Puzzle)" and the app's icon and branding are used by us in connection with the app. Nothing in these Terms transfers any of those rights to you; you receive only the licence described in section 3.
The app includes third-party components — including Android Jetpack libraries and Google's Mobile Ads, Play Billing, and Play Games Services SDKs — which remain the property of their respective owners and are used under their own licence terms. Those terms continue to apply to those components and, to the extent they conflict with these Terms in respect of those components, they prevail.
If you send us feedback, bug reports, or feature suggestions, you grant us a non-exclusive, worldwide, royalty-free, perpetual licence to use them to improve the app, without any obligation to compensate you or keep them confidential. You are not required to send us feedback, and we claim no rights in anything else you create.
9. Disclaimer of warranties
To the fullest extent permitted by applicable law, the app is provided "as is" and "as available", without warranties or conditions of any kind, whether express, implied, or statutory — including any implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, or non-infringement.
In particular, we don't warrant that:
- the app will be uninterrupted, timely, secure, or free of errors or defects, or that defects will be corrected;
- it will run correctly on every device, Android version, or configuration;
- ads, in-app purchasing, or Google Play Games Services will always be available; or
- your scores, coins, themes, or saved games will never be lost or corrupted — although the app's local storage and optional cloud save are designed to reduce that risk.
Some jurisdictions don't allow the exclusion of certain warranties or of implied statutory guarantees for consumers. Where that's the case, the exclusions above apply only to the extent permitted, and your mandatory statutory rights as a consumer — for example under EU/UK digital content rules or Israeli consumer protection law — are unaffected.
10. Limitation of liability
To the fullest extent permitted by applicable law, and except as stated in the final paragraph of this section, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or saved game progress, or for damage to your device or software, arising out of or in connection with your use of, or inability to use, the app — whether the claim is based on contract, tort (including negligence), or any other legal theory, and even if we've been advised that such damages are possible.
To the fullest extent permitted by applicable law, our total aggregate liability arising out of or in connection with the app and these Terms is limited to the greater of (a) the total amount you actually paid for in-app purchases in the twelve months before the event giving rise to the claim, or (b) USD 20 (or the equivalent in your local currency).
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for wilful misconduct or gross negligence, or for any other liability that cannot lawfully be excluded or limited. If you are a consumer, the limitations in this section apply only to the extent permitted by the consumer law of your country, and we remain responsible for loss or damage that is a foreseeable result of our breach of these Terms.
11. Termination and discontinuation
You may stop using the app at any time, for any reason, by uninstalling it. Uninstalling removes the locally stored app data described in section 1 of our Privacy Policy — including your coin balance, unlocked themes, and saved board — and that data cannot be recovered by us, because we never had a copy of it.
We may update, modify, suspend, or discontinue the app or any part of it — including specific ad placements, coin-economy values, Play Games Services integration, or the app as a whole — at any time. We'll make reasonable efforts to avoid disrupting content you've already purchased and, where a change is significant and we can reasonably give notice, to announce it (for example, through the app's Google Play listing or an in-app notice).
Your licence under section 3 ends automatically if you materially breach section 3 or section 4. On termination for any reason you must stop using the app and uninstall it. If the app is permanently discontinued, coins and in-app entitlements will stop functioning and, subject to your mandatory statutory rights and Google Play's refund policy, we're not obliged to provide compensation for them. Sections 5 (virtual currency has no value), 8, 9, 10, and 12 survive termination.
12. Governing law and disputes
Let's try email first. If you have a problem with the app or a purchase, please write to [email protected] before starting any formal proceedings. Most issues — especially purchase and refund issues — are resolved far faster this way, and we'll make a genuine effort to respond and resolve within 30 days.
These Terms, and any dispute arising out of or in connection with them or the app, are governed by the laws of the State of Israel, without regard to its conflict-of-law rules, and the competent courts of Israel will have jurisdiction.
This does not override your consumer rights. If you are a consumer habitually resident in another country, nothing in this section deprives you of the protection of the mandatory provisions of the law of that country, and you may bring proceedings in your local courts where that law gives you the right to do so. We do not require you to arbitrate, and we do not ask you to waive any right to participate in class or representative proceedings where such a waiver would be unenforceable.
If any provision of these Terms is found unenforceable, it will be limited or removed to the minimum extent necessary and the remaining provisions stay in force. Our failure to enforce a provision isn't a waiver of it. These Terms, together with our Privacy Policy, are the entire agreement between you and us about the app. You may not transfer your rights under these Terms; we may transfer ours if the app changes hands, provided your rights under these Terms are not reduced.
13. Changes to these Terms
We may update these Terms from time to time — for example, to reflect new app features, changed monetization, or legal requirements. We'll update the "Last updated" date at the top when we do, and where a change is material we'll make reasonable efforts to bring it to your attention (for example, through the app's Google Play listing or an in-app notice).
Changes take effect when published, and your continued use of the app after that constitutes acceptance of the updated Terms. If you don't accept a change, your remedy is to stop using the app and uninstall it. Changes never apply retroactively to purchases you've already completed or to rights that have already accrued.
